The legal side, in plain English
NRIs and OCIs may purchase residential and development-authority-allotted residential plots (including YEIDA plots) under FEMA / NDI Rules 2019. Agricultural land, farmhouses and plantations are not permitted.
Route via your NRE or NRO account through normal banking channels. No limit on NRE inward remittances. Payments are split into construction milestones, making it straightforward to remit in tranches from your Saudi salary.
Gulf-based NRIs get the PoA consulate-attested (not apostille) at the Indian consulate in Riyadh or Jeddah. A trusted person in India then signs on your behalf. We guide you through the document list.
LTCG TDS rate is 12.5% (post 23 Jul 2024) plus applicable surcharge and cess, unless you obtain Form 13 from the income-tax department. NRE-funded proceeds repatriable for up to two residential properties; NRO route capped at USD 1M per year. Consult your CA — we flag what you need to ask.
