The legal side — in plain English for US residents
Buying Indian property from the US has a clear legal framework. Here are the four things that matter most.
NRIs and OCIs may purchase residential property and development-authority-allotted residential plots (such as YEIDA plots) under FEMA / NDI Rules 2019. Agricultural land, farmhouses and plantations are not permitted. Consult your CA/FEMA advisor to confirm eligibility.
From the US, your PoA is notarised by a US notary, then apostilled at your state's Secretary of State office (the US is a Hague Convention signatory). This lets your representative in India sign property documents on your behalf — no India trip required to close.
Wire funds from your US bank to your NRE or NRO account in India, then disburse to the builder via Indian banking channels. No cash. Construction payments are milestone-linked to verified progress. We coordinate with your bank and flag 15CA/15CB paperwork.
NRE-funded proceeds are repatriable for up to two residential properties. NRO repatriation is capped at USD 1 million per financial year. LTCG TDS is 12.5% post-23 July 2024 plus applicable surcharge and cess; a Form 13 application may reduce TDS withholding. Please consult your CA.
