NRI / OCI eligibility — who can buy

NRIs and OCIs resident in Kenya can buy Indian residential plots.

Under FEMA and the NDI Rules 2019, Indian passport holders (NRIs) and OCI card holders — including those resident in Kenya — are permitted to purchase residential and development-authority-allotted residential plots. Here is what is allowed and what is not.

Permitted: residential plots & YEIDA plots

NRIs and OCIs may purchase residential property and development-authority-allotted residential plots — including YEIDA corridor plots — in India. These are the plot types Vidastu works with.

Not permitted: agricultural land, farmhouses, plantations

Agricultural land, farmhouses and plantation properties are not permitted under FEMA for NRIs and OCIs. We only work with permitted categories — confirm eligibility with your CA.

OCI card holders

OCI card holders have the same property purchase rights as NRIs for residential and development-authority residential plots. If your family received Kenyan citizenship and holds an OCI card, you remain eligible. Confirm your specific situation with your CA.

Payment routing

Purchase price paid through NRE, NRO or FCNR account via normal banking channels. No cash transactions. Vidastu coordinates with your India-based bank on documentation.

Kenya residents can buy legally. Here's how it works — including the PoA process.

FEMA and the NDI Rules 2019 permit NRIs and OCIs — including Kenya residents — to purchase residential and YEIDA-allotted residential plots. Your Power of Attorney is attested at the Indian High Commission in Nairobi — Kenya's standard process for legal documents used in India.

NRE / NRO / FCNR routing

Pay through your NRE, NRO or FCNR account via normal banking channels. No cash transactions. We coordinate with your India bank.

Power of Attorney — Indian High Commission, Nairobi

Kenya is not a Hague Convention country. Your PoA is executed and attested at the Indian High Commission in Nairobi. This is the standard, well-established process for Kenya-based NRIs and OCIs — a trusted person then signs in India on your behalf. We guide you through the process step by step.

RERA 70% escrow

For UP-RERA registered projects, at least 70% of buyer funds are held in a project-specific escrow account, released only against verified milestones (RERA Section 4(2)(l)(D)).

Repatriation & TDS

NRE-funded sale proceeds are repatriable for up to two residential properties; NRO route is capped at USD 1M per year. LTCG TDS is 12.5% (post-23 Jul 2024) plus surcharge/cess unless Form 13 applies. Consult your CA — we flag the forms, not the liability.
